GENERAL TERMS AND CONDITIONS
Registration and conclusion of contract
By registering in writing or verbally or by accepting an offer, the contractual partner, hereinafter referred to as the customer, makes a binding offer to conclude a contract. In the case of group bookings, this registration or acceptance applies to the entire group and the claims arising from the booking. By registering or accepting, the customer accepts the General Terms and Conditions. The booking becomes binding as soon as the ordered service is confirmed in writing, by email or verbally by MucTours GmbH, hereinafter also referred to as the organiser.
Group size
The maximum number of people for booked events is 15 per city guide. If this number is exceeded, additional city guides must be requested according to the number of people in the group. If the maximum group size is not observed when ordering or if a corresponding change in the number of people is not notified at least 7 days before the booked tour, an additional surcharge equal to the agreed price will be payable. In justified cases, the maximum group size may be deviated from in consultation with the organiser. In this case, the organiser reserves the right to re-set the price of the service according to the number of persons.
Cancellation conditions
The organiser may cancel orders with fewer than 5 participants up to 24 hours before the event, in which case all bookers will be informed accordingly. In addition, the organiser may cancel the event at short notice in the event of force majeure, sudden illness or non-appearance of a city guide. In such cases, rescheduling or a refund is possible.
Cancellation is also possible if participants disrupt the event in a sustained manner or behave in a manner contrary to the contract. An order that has already been confirmed can only be cancelled in writing.
Cancellation by the customer is free of charge up to 10 days before the event. Between 10 and 4 days before the event, a cancellation fee of 50% of the order value will be charged. From three days before the event, the full amount is payable. This also applies to deviations from the originally booked event. However, the organiser will attempt to find an alternative solution (e.g. another date or another tour) in consultation with the customer.
Terms of payment
Unless otherwise agreed, the event must be paid for in advance online or by credit card or bank transfer. For exclusive group bookings, payment shall be made by invoice without any deductions. In exceptional cases, payment can be made in cash to the city guide on site against receipt.
Services and changes to services
The scope of the contractual services is set out in the organiser’s service description. Subsidiary agreements require written confirmation (usually by email) from the organiser. The cancellation of individual parts of the service does not entitle the customer to withhold the contract amount or to make a partial deduction, provided that the reasons for this are not attributable to the organiser. If the organiser is responsible for the cancellation of individual services, they have the right to replace these services with other services of equal value. The organiser is obliged to inform the customer of this. If necessary, the organiser will offer the customer a free rebooking or a free cancellation.
Delays and waiting times
The city guide is obliged to wait for the group at the agreed meeting point for 15 minutes. After this time, the claim to the event expires, whereby the agreed amount must be paid in full by the client. If the guests to be guided arrive late, the event can be extended by the amount of time they are late, if the city guide’s schedule allows. Otherwise, the event will be shortened by the amount of time spent waiting. The fee will then be calculated based on the waiting time and the event time. If an event is interrupted at the request of the group, there is no entitlement to an extension of the event afterwards.
Duty of supervision
The organiser does not assume any duty of supervision for events involving children, young people or other persons requiring supervision. This remains the responsibility of the client throughout the entire event.
Obligation to cooperate
The customer or the participants in a group of the customer are obliged to cooperate in the event of service disruptions within the framework of the statutory provisions in order to avoid or minimise any damage. In particular, they are obliged to notify the organiser of any complaints without delay.
Cancellation of an event
The city guide is entitled to refuse an event or to immediately cancel an event that has already begun if individual participants or the entire group behave inappropriately to such an extent that immediate termination is justified (e.g. personal attacks on the city guide), regardless of a warning. In such a case, the claim for payment remains valid.
Liability
Participation in the events is at your own risk. The organiser accepts no liability for accidents or damage affecting participants. The organiser is only liable for the conscientious preparation of the events, the careful selection and supervision of service providers, the accuracy of the service description and the proper provision of the contractually agreed service. The organiser is not liable for services that are arranged as third-party services from other service providers (e.g. catering companies).
Written form requirement
All agreements must be made in writing (by email). A contract becomes legally binding when the organiser has confirmed the order to the client in writing.
Film and sound recordings
For copyright reasons, film and sound recordings must be agreed with the organiser prior to the event. The organiser will also explicitly indicate if film and sound recordings are planned on their part.
Special rules for events
As a rule, it is not possible to change the starting point and schedule of an event, as the tours follow a chronological sequence. The starting and ending points, duration, content and route of the event may vary in exceptional cases. In the case of exclusive group tours, individual arrangements can be made in advance.
Limitation period
Claims by the customer against the organiser shall generally expire after one year, beginning at the end of the year in which the claim arose.
Ineffectiveness (severability clause)
The invalidity of individual provisions of the contract and the General Terms and Conditions does not invalidate the entire contract. The parties undertake to replace the invalid provision with a valid provision that comes as close as possible to the invalid provision.
Place of performance and jurisdiction
The place of performance and sole place of jurisdiction is Munich.
